TallyHome: Household Balance - Terms of Service

Please read these Terms of Service ("Terms") carefully before using TallyHome: Household Balance (the "App") developed and operated by Napalm Applications LLC ("us," "we," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

Account Registration and Responsibilities

To use certain features of the App, you must register for an account. You agree to provide accurate, complete, and current information. You are responsible for safeguarding your password and for any activities or actions taken under your account.

TallyHome is designed for household collaboration. You are responsible for the conduct of household members you invite and for the accuracy of data entered into the App. We reserve the right to terminate accounts found to be in violation of these Terms or engaged in fraudulent activity.

Subscriptions and Payments

TallyHome offers both free and Premium subscription tiers.

Billing: Subscriptions are managed through RevenueCat and processed via the Apple App Store or Google Play Store.
Free Trial: A 7-day free trial may be offered to new users. Trial eligibility is determined at the time of account creation and is limited to one trial per user.
Cancellations: You may cancel your subscription at any time through your device's store settings. No refunds are provided for partial subscription periods unless required by applicable law.
Changes: We reserve the right to modify subscription fees or features with reasonable notice to users.

User Content and Conduct

You retain all rights to the data you input into the App ("User Content"). By using the App, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and process your User Content solely for the purpose of providing the service to you and your household members.

You agree not to use the App for any unlawful purpose or to input content that is defamatory, obscene, or infringing on intellectual property rights.

TallyHome as a Tool — No Liability for Household Disputes

TallyHome is a household management and load-balancing tool designed to help households visualize and discuss the distribution of tasks and responsibilities. The App provides data, suggestions, and insights based solely on the information you and your household members enter.

TallyHome, Napalm Applications LLC, and its development team are not responsible for any disputes, conflicts, relationship issues, or outcomes that arise from the use of or reliance on information provided by the App. The App does not provide relationship counseling, legal advice, financial advice, or any form of professional guidance. Any decisions made based on information provided by the App are made solely at your own discretion and risk.

We make no representation that the data displayed in the App accurately reflects the full scope of any household's workload, and we expressly disclaim any liability arising from interpretations or actions taken based on App data.

Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Napalm Applications LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Limitation of Liability

In no event shall Napalm Applications LLC, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of (or inability to access or use) the App.
Any conduct or content of any third party on or through the App.
Any content obtained from the App.
Unauthorized access, use, or alteration of your transmissions or content.
Any household disputes, relationship conflicts, or interpersonal outcomes arising from use of or reliance on the App.

Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.

App Access and Activation
TallyMed is available as a free download. Full access to the App's features requires a one-time activation, either through an in-app purchase processed via the Apple App Store or Google Play Store, or through an activation code provided by a participating healthcare provider. Activation codes are single-use and non-transferable. We reserve the right to deactivate codes found to be in violation of these Terms or obtained fraudulently.

Your Data
TallyMed is a local-only application. All data you enter into the App — including medication names, dosage information, and dose logs — is stored exclusively on your device and is never transmitted to, or accessible by, Napalm Applications LLC or any third party. We have no access to your data and cannot recover it if your device is lost, damaged, or reset. You are solely responsible for maintaining your data.

TallyMed as a Tool — No Medical Advice
TallyMed is a personal medication tracking tool designed to help you log and monitor your own medication schedule. The App is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. The App does not provide medical advice, clinical guidance, or professional healthcare recommendations of any kind.

Napalm Applications LLC and its development team are not responsible for any health outcomes, medication errors, missed doses, or adverse events arising from the use of or reliance on the App. Any decisions made regarding your medications or health are made solely at your own discretion and risk. Always consult a qualified healthcare professional before making decisions about your medications or health.
